TERMS OF SERVICE

Acceptance of Terms

By accessing, purchasing from, or using services provided by Crossroads Medical Supply (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use our services.

Services Provided

We provide durable medical equipment (“DME”), supplies, and related services, including but not limited to:

  • Equipment sales and rentals

  • Insurance billing and coordination

  • Delivery, setup, and patient education

  • Ongoing service and support

All services are subject to availability and applicable federal and Texas laws.

Eligibility

You must be at least 18 years old or have a legally authorized representative.

By using our services, you represent that:

  • All information provided is accurate and complete 

  • You are authorized to use any insurance submitted

Physician Orders & Medical Necessity

Certain items require a valid physician order. 

  • We may verify medical necessity and documentation

  • All orders must comply with Medicare, Medicaid, and commercial payer requirements

  • We reserve the right to refuse service if documentation is incomplete or non-compliant

Insurance & Payment Responsibilities

We may bill insurance as a courtesy.

However, you are ultimately responsible for all charges, including:

  • Deductibles

  • Copayments

  • Coinsurance 

  • Non-covered items 

  • Denied claims

If insurance denies payment for any reason, you agree to pay the remaining balance. We may require payment in advance for certain items or services

Rentals & Equipment Use

Rental equipment remains the property of Crossroads Medical Supply unless purchased.

You agree to:

  • Use equipment as instructed 

  • Maintain equipment in good condition

Report damage or malfunction promptly You are responsible for: 

  • Loss, theft, or damage beyond normal wear and tear

Failure to return equipment may result in additional charges and legal action.

Returns & Refunds

Due to hygiene and safety regulations:

  • Many medical items are non-returnable

  • Eligible returns require prior authorization

  • Items must be unused and in original condition

Restocking fees may apply. Custom or special-order items are non-refundable.

Delivery & Setup

Delivery times are estimates and not guaranteed.

You agree to:

  • Provide safe and accessible delivery conditions

We are not responsible for delays outside our control.

Patient Responsibility & Training

You are responsible for: 

  • Following all instructions

  • Using equipment safely

We do not provide medical diagnosis or treatment. Always consult your physician.

CPAP & CGM Resupply Programs

We offer recurring resupply programs for CPAP and CGM supplies.

Eligibility

Subject to:

  • Valid physician orders 

  • Continued medical necessity 

  • Insurance guidelines

Frequency

Supplies are shipped based on:

  • Manufacturer recommendations 

  • Payer requirements

Patient Responsibilities

You agree to notify us of: 

  • Changes in insurance

  • Address changes

  • Discontinuation of therapy

Insurance Billing

We may bill insurance for each shipment. You remain responsible for all patient balances.

Confirmation

We may contact you prior to shipment. Failure to confirm may delay service.

Auto-Ship Authorization

By enrolling in auto-ship, you authorize us to: 

  • Ship supplies on a recurring basis 

  • Bill your insurance and/or payment method on file

Payment Authorization

You authorize charges for:

  • Recurring shipments 

  • Outstanding balances

Cancellation

You may cancel or modify auto-ship with reasonable notice prior to shipment.

Failed Payments

We may delay or cancel shipments if payment fails.

Equipment Maintenance & Service

We may provide maintenance and service agreements.

You agree to: 

  • Properly maintain equipment 

  • Report issues promptly

Service does not cover damage due to misuse, neglect, or unauthorized modification.

Collections & Late Payment Policy

Payment Terms

are due upon receipt unless otherwise agreed.

Delinquent Accounts

We may:

  • Suspend services 

  • Require prepayment

Collections

Unpaid accounts may be referred to collections.

You agree to pay all lawful collection costs, including: 

  • Collection agency fees

  • Attorney’s fees (as permitted under Texas law)

Returned Payments

Fees may apply for returned or failed payments.

E-Commerce Terms (If Applicable)

Orders

We reserve the right to: 

  • Cancel or refuse orders

  • Correct pricing errors

Payment

Payment is required at time of purchase unless billed to insurance.

Shipping

Delivery timelines are estimates.

Returns

Subject to our return policy; many medical items are non-returnable.

Website Use

You agree not to misuse the website or provide false information.

Intellectual Property

All content is owned by Crossroads Medical Supply and protected by law.

HIPAA & Privacy

We comply with the Health Insurance Portability and Accountability Act (HIPAA).

Your information is used for: 

  • Treatment

  • Payment

  • Healthcare operations

You consent to receive communications via: 

  • Phone

  • Email

  • Text messages

Related to your account, orders, and services.

Limitation of Liability

To the fullest extent permitted by Texas law:

We are not liable for:

  • Improper use of equipment

  • Injuries due to misuse

  • Third-party delays

Our total liability shall not exceed the amount paid for the product or service.

Warranty Disclaimer

Products may include manufacturer warranties.

Except as expressly stated:

  • All products are provided “as is” 

  • We disclaim all other warranties to the extent allowed under Texas law

Compliance with Laws

We comply with all applicable laws, including: 

  • Medicare Supplier Standards (42 CFR § 424.57)

  • Federal Anti-Kickback Statute 

  • Texas healthcare regulations

You agree not to use our services for unlawful purposes.

Refusal of Service

We reserve the right to refuse or discontinue service if: 

  • Fraud is suspected 

  • False information is provided 

  • Terms are violated

Governing Law & Venue (Texas-Specific)

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any legal action or proceeding shall be brought exclusively in: 

  • State courts located in Texas, or

  • Federal courts with jurisdiction in Texas

You consent to personal jurisdiction and venue in these courts.

Dispute Resolution (Optional but Strong Protection)

To the extent permitted by Texas law: 

  • Parties agree to attempt to resolve disputes informally first

  • If unresolved, disputes may be subject to binding arbitration in Texas

Changes to Terms

We may update these Terms at any time.

Continued use of services constitutes acceptance of the updated Terms.
